TERMS & CONDITIONS
These Terms & Conditions apply to all swimming sessions and bookings at Mutts & Mittens Active Clarke Quay, operated by Mutts & Mittens Pte Ltd.
Please read these Terms & Conditions carefully before making a booking. By making a booking or entering our premises, you confirm that you have read, understood and agreed to these Terms & Conditions. These Terms & Conditions are legally binding and may affect how your dog(s) are cared for and how the facilities are used.
These Terms apply to both public swim sessions and private pool bookings, unless otherwise stated.
- Your Status
By placing a booking through our website or any communication channel, you confirm that:
- You are legally capable of entering into binding contracts;
- All information provided by you is accurate and complete; and
- You accept these Terms & Conditions in full.
Entry into the premises constitutes acceptance of these Terms & Conditions.
- Booking Party Declaration (Private Bookings)
For private pool bookings, the individual making the reservation (“Booking Party”) shall be deemed the main point of contact and shall be responsible for the booking and for all persons and dogs attending the session.
By confirming a private booking, the Booking Party:
- Confirms that all attending persons and dog owners have been informed of these Terms & Conditions;
- Agrees that all attending persons and dog owners shall be bound by these Terms & Conditions; and
- Accepts responsibility for ensuring compliance with these Terms & Conditions by all attending persons and dogs.
The Booking Party shall be responsible for any damage, injury, loss or policy breach caused by any attending person or dog.
The Booking Party further agrees to indemnify Mutts & Mittens Pte Ltd against any claims arising from any attending person or dog.
- Formation of Contract
Upon placing a booking online or through other communication channels, you will receive an acknowledgement that your booking request has been received. This acknowledgement does not constitute acceptance of the booking.
A binding contract shall only be formed when:
- Full payment has been received;
- Booking confirmation has been issued.
Mutts & Mittens Pte Ltd reserves the right to accept or reject any booking without assigning a reason.
- Payment Terms
All bookings must be paid in full in order to be confirmed.
Accepted payment methods include:
- Credit Cards
- Debit Cards
- Paynow
Bookings are only confirmed upon receipt of full payment.
All prices include GST where applicable.
- Cancellation and Rescheduling
Rescheduling and cancellation of bookings shall be governed by the Mutts & Mittens Active Clarke Quay Rescheduling Policy, and may be updated from time to time.
By confirming a booking, the customer acknowledges that they have read, understood, and agreed to the entirety of the Rescheduling Policy, and accepts that the policy shall form part of these Terms & Conditions.
Customers will be required to separately acknowledge and agree to the Rescheduling Policy at the point of booking. Such acknowledgement shall constitute binding acceptance of the policy.
Mutts & Mittens Pte Ltd reserves the right to interpret and apply the Rescheduling Policy in a fair and reasonable manner.
- Health & Vaccination Requirements
Please ensure your dog is in good health before attending a swim session.
Dogs displaying signs of illness including but not limited to:
- Vomiting
- Diarrhoea
- Coughing
- Runny nose
- Skin infections
- Open wounds
may be refused entry without refund.
Customers will be required to declare acknowledgement of their dog’s vaccination or titre test validity at the point of booking.
It is the owner’s responsibility to ensure that their dog:
- Has adequate and valid core vaccination protection (DHLPP – Canine Distemper, Canine Hepatitis, Leptospirosis, Parvovirus and Parainfluenza), or a valid titre test accompanied by an annual Leptospirosis vaccination;
- Is adequately protected against parasites; and
- Is medically fit to participate in swimming activities.
Vaccinations or titre tests must have been administered no more than twelve (12) months prior to the visit, and not less than fourteen (14) days before the scheduled session, in order to allow sufficient time for immunity to develop following vaccination.
Owners may be requested, on a random basis, to produce their dog’s vaccination records for verification prior to entry. A digital or soft copy will be accepted.
- Shared Facility Environment
Mutts & Mittens Active Clarke Quay is a shared-use dog facility visited by many dogs on a regular basis.
While we maintain structured cleaning and water management procedures to support a hygienic and well-maintained environment, owners acknowledge that interaction between dogs and shared-use facilities naturally involves some level of environmental exposure.
Mutts & Mittens Pte Ltd shall not be held responsible for any communicable diseases, illnesses or infections that may occur before, during or after visiting the facility unless directly caused by proven negligence.
- Medical Fitness and High-Risk Dogs
Swimming is a physical activity that carries inherent risks.
Certain dogs may be at increased risk including but not limited to:
- Puppies
- Senior dogs
- Brachycephalic breeds
- Dogs with heart conditions
- Dogs with seizure history
- Dogs with joint conditions
- Dogs recovering from injury, surgical procedures, ill health
By attending a swim session, owners confirm that their dogs are medically fit to participate.
Mutts & Mittens Pte Ltd shall not be liable for any medical episode, injury, complication or deterioration of pre-existing conditions arising during or after a session unless directly caused by proven negligence.
Owners remain responsible for monitoring their dogs throughout the session and agree to seek veterinary attention at their own cost where necessary.
- Supervision and Safety
Owners are responsible for supervising their dogs at all times.
Dogs must remain under effective control throughout the session.
Private swim sessions are self-supervised sessions.
While staff may be present to facilitate operations, staff members are not lifeguards and are not responsible for active supervision of dogs or guests.
Mutts & Mittens Pte Ltd accepts no responsibility for injuries sustained due to inadequate supervision by owners.
Participation in swimming activities is undertaken at the owner’s own risk.
- Conduct in the Pool Area
Owners must ensure safe conduct at all times.
Activities that may result in injury, unconsciousness, drowning or unsafe conditions are strictly prohibited.
No food or drinks may be consumed in the pool. This includes dog treats.
Customers who arrive late for their session will still be required to end their session at the originally designated time.
- Pool Contamination Policy
Owners must toilet their dogs prior to entering the facility.
Despite preventive measures, contamination incidents may occur from time to time.
In the event of faecal contamination:
- Staff will carry out cleaning procedures;
- The session may be suspended or terminated if necessary;
- No refunds shall be provided; and
- Additional cleaning or downtime charges may be imposed where necessary.
- Water Quality Management
Mutts & Mittens Active Clarke Quay maintains a structured water monitoring programme including regular testing, filtration and chemical treatment.
While the water is continuously filtered and sanitised, owners acknowledge that a shared-use pool environment cannot be guaranteed to be sterile at all times.
Participation in swimming activities is undertaken at the owner’s own risk.
- Behaviour and Control
Dogs must be manageable and under effective control at all times.
Aggressive, disruptive or unsafe behaviour may result in immediate termination of the session without refund.
Owners shall be responsible for any damage to premises, equipment or facilities caused by their dogs or guests.
- Entry Requirements
A typical public swim sessions allow entry for:
- One dog
- Two accompanying persons
Admission for additional guests are available for purchase.
Children under 10 years old are not permitted.
Scheduled dogs and their crosses are only permitted under private bookings.
- Limitation of Liability
To the fullest extent permitted by law, Mutts & Mittens Pte Ltd shall not be liable for any injury, illness, death, loss or damage arising from the use of the facilities.
Where liability is established, the maximum liability of Mutts & Mittens Pte Ltd shall be limited to the amount paid for the booking.
- Indemnity
The customer and Booking Party agree to indemnify and hold Mutts & Mittens Pte Ltd harmless from any claims, losses, damages or legal costs arising from:
- Their dogs;
- Their guests;
- Their actions; or
- Their negligence.
- Photography and Media
Mutts & Mittens Pte Ltd may take photographs or videos for marketing purposes unless prior written notice is provided.
Commercial filming is not permitted without prior written approval.
- Right of Refusal
Mutts & Mittens Pte Ltd reserves the right to:
- Refuse entry;
- Remove any person or dog; or
- Terminate any session
where deemed necessary for safety, operational or reputational reasons.
- Force Majeure
Mutts & Mittens Pte Ltd shall not be liable for failure or delay in performing obligations where such failure arises from events beyond reasonable control.
- Amendments
Mutts & Mittens Pte Ltd reserves the right to revise and amend these Terms & Conditions from time to time.
Customers shall be subject to the Terms & Conditions in force at the time of booking.
- Entire Agreement
These Terms & Conditions represent the entire agreement between Mutts & Mittens Pte Ltd and the customer and supersede any prior agreements or representations.
- Governing Law
These Terms & Conditions shall be governed by the laws of Singapore.
Any dispute arising from these Terms & Conditions shall be subject to the jurisdiction of the Courts of the Republic of Singapore.
